Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Kreev mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") with Kreev Informatics Inc. ("Kreev", "we", "our", "us"). If you do not agree, do not use the App.

Because Kreev has no user accounts, your acceptance is recorded on your own device. If you reinstall the App, you will be asked to accept these Terms again.

2. Description of Service

Kreev is a personal health informatics application that reads biometric data from Apple Health and computes personalized wellness analytics, including:

  • A daily Recovery Score (0–100) derived from your personal physiological baseline
  • A daily Strain score reflecting cardiovascular training load
  • Autonomic intelligence metrics (HRV trends, sleep analysis, respiratory rate)
  • Longitudinal aerobic capacity tracking (VO2 Max)
  • Daily, weekly, and monthly wellness narratives

Kreev runs on your device. All analysis is computed on your iPhone, and all of your data is stored on your iPhone. Kreev operates no servers that receive, process, or store your health information, and the App works without an internet connection.

Use of Kreev requires an iPhone running iOS 16 or later and an Apple Watch or compatible wearable syncing to Apple Health. You are responsible for maintaining your device and any associated costs.

Kreev is not a medical device. Scores, narratives, and all outputs are personal informatics derived from your own baseline data. They are not clinical assessments, diagnoses, or treatment recommendations. Do not use Kreev as a substitute for professional medical advice.

3. Eligibility and Availability

You must be at least 18 years of age to use Kreev. By using the App, you represent that you are 18 or older.

The App is offered to residents of the United States and of Canada, excluding the Province of Quebec. The App is not currently offered in Quebec, and by using the App you represent that you are not a resident of Quebec. We may expand availability in future releases.

Your confirmation of age and residency is recorded on your device, and will be requested again if you reinstall the App.

4. No Account — and What That Means for Your Data

Kreev has no accounts. There is no sign-in, no username, no password, and no profile held by us. You are not identified to Kreev, and we hold no record of you.

This has a consequence you should understand before relying on the App. Your Kreev history exists only on your device. We keep no copy and cannot recover it for you — not if your phone is lost or stolen, not if it is erased, not if you delete the App, and not if the data becomes corrupted. No support request can restore it, because there is nothing on our side to restore from.

Two safeguards are available, and it is your responsibility to use them:

  • iCloud Backup — if enabled in iOS, your device backup includes Kreev's data and is restored automatically when you set up a new iPhone from that backup. It restores at device migration; it does not sync continuously, and it will not keep two devices in step.
  • Settings → Export My Data — produces a file you keep yourself and can bring back into the App with Settings → Import My Data.

To the maximum extent permitted by law, Kreev is not liable for any loss of your data, however caused, including device loss, device failure, deletion of the App, an unsuccessful iCloud restore, or your not having enabled a backup.

Your subscription is not affected by any of this: it is attached to your Apple ID, not to your device (Section 5.7).

5. Subscriptions and Billing

5.1 Subscription Plans

Kreev offers a free tier and a paid "Sentinel" tier. Sentinel is available as a monthly (USD $5.99) or annual (USD $39.99) auto-renewing subscription, purchased through Apple in-app purchase. Prices are set in US dollars and displayed in your local currency by the App Store; the price shown in the App Store at the time of purchase is the price that applies to you.

5.2 Introductory Free Trial

Sentinel may be offered with an introductory free trial through the App Store. Any introductory offer is administered by Apple: it is available once per Apple ID, its length and terms are shown on the purchase screen at the time of purchase, and it requires selecting a subscription plan. Unless you cancel at least 24 hours before the trial ends, the subscription converts to a paid subscription at the price shown when you accepted the offer. You may cancel at any time during the trial via iPhone Settings → Apple ID → Subscriptions, and you will not be charged.

Because Kreev has no accounts, Kreev itself cannot grant, extend, or track a trial; eligibility is determined by Apple against your Apple ID, not by the App or by this device. No data is deleted when a trial ends — your scores, metrics, and history remain on your device; Sentinel features (Section 5.6) simply become unavailable unless the subscription continues.

5.3 Auto-Renewal, Cancellation, and Refunds

Your subscription — including a subscription that began with an introductory free trial — automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. The renewal charge is applied to your Apple ID account. You may cancel at any time via iPhone Settings → Apple ID → Subscriptions; cancellation takes effect at the end of the current billing period. If you have allowed notifications, the App also reminds you on your device about three days before each renewal — including the first charge at the end of an introductory trial. This reminder is a courtesy: the renewal terms in this section apply whether or not it is delivered, and Apple separately notifies you about your subscriptions under its own terms. Billing, refunds, and payment disputes are handled by Apple under the App Store terms; Kreev does not process payments directly. Nothing in this section limits any non-waivable refund rights you have under the consumer protection law of your state or province.

5.4 Price Changes

We may change subscription pricing with at least 30 days' notice, communicated through the App. Price changes for auto-renewing subscriptions take effect in accordance with Apple's subscription price-change process, which may require your affirmative consent.

5.5 Free Tier

The free tier includes the App's core daily readings: your Recovery Score, your Strain score, your VO2 Max value, and your overnight metrics (HRV, Resting Heart Rate, Sleep, Respiratory Rate, Steps and Activity), together with 7-day metric trends, the current month of history, and a daily insight.

Your VO2 Max reading is shown in full on the free tier. What is not included is the interpretation of that reading — where it places you against ACSM population norms for your age and biological sex, your percentile band, and the distance to the next band. That ranking is a Sentinel feature (Section 5.6).

5.6 Sentinel Tier

Sentinel adds analytical depth. It includes:

  • Full wellness narratives (daily, the weekly debrief, and the monthly review), in place of the free tier's daily insight
  • The Healthspan Index and its component breakdown (Section 22.5)
  • The VO2 Max ACSM ranking — category, percentile band, position, and distance to the next band
  • Recovery contributing-factors analysis
  • Extended trends and history beyond the current month
  • Detailed metric analysis and drill-downs
  • Guardian Alerts (Section 8)

The current feature list for each tier is shown in the App and on the purchase screen; where these Terms and the purchase screen differ, the purchase screen at the time of purchase governs.

5.7 Restoring a Purchase

Because Kreev has no accounts, your subscription is attached to your Apple ID. On a new device, or after reinstalling the App, use Settings → Restore Purchases to re-establish your Sentinel access. You must be signed in to the App Store with the Apple ID used to purchase.

Restoring a purchase restores your subscription entitlement only. It does not restore your Kreev history, which is covered by Section 4.

6. Health Data and Apple Health

By granting Kreev access to Apple Health, you authorize the App to read the data types listed in our Privacy Policy, on your device, for the purpose of computing your Recovery Score, Strain score, and wellness metrics.

Kreev only reads from Apple Health. It does not write to it, and does not alter your Health data.

You may revoke access at any time via iPhone Settings → Privacy & Security → Health → Kreev. Revoking access stops the App from computing current scores, but does not erase what is already stored on your device — use Settings → Reset This Device, or delete the App, for that.

7. Wellness Narratives

Kreev's daily, weekly, and monthly narratives are generated by a rule-based engine that runs on your device. It composes text from a fixed library of phrases according to your own metrics. The same inputs always produce the same narrative.

No artificial-intelligence or large-language-model service is used, and no narrative data is transmitted anywhere.

Narratives:

  • Are observational statements about patterns in your own biometric data
  • Are informational, not medical opinions, and are not a diagnosis
  • May be incomplete or may not reflect factors the App cannot observe
  • Depend on the accuracy of the underlying sensor data

You must exercise independent judgment before acting on any narrative, and you agree not to rely on one as a basis for a medical decision. To the maximum extent permitted by law, Kreev bears no liability arising from narrative content.

8. Guardian Alerts

Kreev's Guardian Protocol shows a notification when the App detects a significant negative deviation in your recovery state — currently, a Recovery Score below a defined threshold combined with a significant drop in your HRV relative to your personal baseline. This is evaluated on your device and delivered as a local iOS notification; no server is involved and nothing is transmitted. The detection thresholds are set by Kreev and are not user-configurable; you may control whether the alert displays your score value in the App's Settings, and may disable notifications entirely in iOS Settings.

Guardian Alerts are informational only. They depend on your device analysing new health data, which requires that you open the App and that data be available in Apple Health. They are not a continuous monitoring service, not an emergency response system, and must never be relied upon as a substitute for emergency medical services or medical supervision. An alert may be delayed or may not appear at all.

9. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, or modify the App
  • Attempt to gain unauthorized access to our systems
  • Use the App to transmit malicious code or interfere with other users

10. Your Data

We do not receive your data, and we claim no rights over it.

Your health metrics, computed scores, narratives, and check-ins remain on your device. Kreev has no access to them and no ability to obtain them. We do not use them to improve the App, to train models of any kind, or for any other purpose — not in identified form, and not in de-identified or aggregated form.

What does reach us is limited to the subscription and anonymous product-usage information described in Sections 2.4–2.6 of our Privacy Policy, none of which contains health data.

11. Feedback

If you provide feedback, suggestions, ideas, screenshots, or descriptions of bugs through any channel, you grant Kreev Informatics Inc. a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate that feedback into the App and related products without obligation or compensation to you. Anything you send us is something you have chosen to send — the App transmits nothing on its own.

12. Intellectual Property

All content, features, and functionality of the Kreev App — including the Recovery Score algorithm, design system, and narrative engine — are the exclusive property of Kreev Informatics Inc. and are protected by applicable intellectual property laws. Your license to use the App is personal, non-exclusive, non-transferable, and revocable.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT RECOVERY SCORES OR STRAIN SCORES ACCURATELY REFLECT YOUR PHYSIOLOGICAL STATE, OR THAT DATA STORED ON YOUR DEVICE WILL REMAIN AVAILABLE OR UNCORRUPTED.

KREEV IS NOT A MEDICAL DEVICE AND MAKES NO MEDICAL REPRESENTATIONS. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL FOR MEDICAL CONCERNS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR CONDITIONS; TO THAT EXTENT, THE ABOVE EXCLUSIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY THE LAW OF YOUR JURISDICTION.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KREEV INFORMATICS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO RELIANCE ON RECOVERY SCORES, STRAIN SCORES, OR NARRATIVES FOR HEALTH DECISIONS, AND INCLUDING LOSS OF DATA STORED ON YOUR DEVICE (SECTION 4).

IN NO EVENT SHALL KREEV INFORMATICS INC.'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO KREEV IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, FRAUD, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH LAW APPLIES.

15. Indemnification

You agree to indemnify and hold harmless Kreev Informatics Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your unlawful use of the App. This section does not apply to the extent prohibited by the consumer protection law of your jurisdiction.

16. Dispute Resolution

Please read this section carefully — it affects your legal rights. It includes an arbitration agreement, a class action waiver, and an opt-out right.

16.1 Informal Resolution First

Before starting any formal proceeding, you agree to first contact us at legal@kreev.app describing the dispute. We will attempt in good faith to resolve it within 30 days.

16.2 Binding Arbitration and Class Waiver

If a dispute is not resolved informally, it shall be resolved by binding arbitration administered under the Arbitration Act (Alberta), conducted in Calgary, Alberta, or — where you and Kreev agree — by videoconference. Each party waives any right to a jury trial and to participate in a class action or class-wide arbitration, to the extent such waiver is permitted by applicable law.

16.3 Exceptions

Notwithstanding Section 16.2:

  • Small claims. Either party may bring an individual claim in the small claims court of your province or state of residence, if the claim qualifies.
  • Injunctive relief. Either party may seek injunctive relief in court for unauthorized use of the App or infringement of intellectual property rights.

16.4 Consumer Protection Carve-Out

Nothing in this Section 16 deprives you of the protection of any consumer protection law of your province or state of residence that cannot be waived by contract. If the law of your jurisdiction renders a mandatory arbitration clause or class action waiver unenforceable in consumer agreements (for example, the Ontario Consumer Protection Act, 2002), then Section 16.2's arbitration requirement and/or class waiver do not apply to you, and you may bring your claim in a court of competent jurisdiction in your province or state.

16.5 Opt-Out Right

You may opt out of the arbitration agreement and class waiver in Section 16.2 by emailing legal@kreev.app within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other provision of these Terms.

17. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles. If you reside in the United States or in another Canadian province, this choice of law does not deprive you of the protection of mandatory consumer protection rules of the jurisdiction where you reside.

18. Limitation on Claims

Except where prohibited by applicable law, any claim arising from your use of Kreev must be filed within one (1) year of the date the claim arose, or it shall be permanently barred.

19. Apple App Store Terms

Kreev is made available through the Apple App Store. Your use of Kreev is also subject to Apple's App Store Terms of Service. You acknowledge that:

(a) These Terms are between you and Kreev Informatics Inc. only, not Apple;

(b) Apple has no obligation to provide maintenance or support for Kreev;

(c) Apple is not responsible for any product warranty claims;

(d) Apple is not responsible for addressing any claims related to Kreev, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation;

(e) In the event of any third-party claim that Kreev infringes a third party's intellectual property rights, Kreev Informatics Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim; and

(f) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

20. Severability and Assignment

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without your consent, provided such assignment does not materially diminish your rights.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kreev Informatics Inc. regarding the use of Kreev.

22. Algorithm Transparency and Automated Scoring

Every computation described in this section runs on your own device. No score, metric, or narrative is computed on, or transmitted to, any server.

22.1 How Your Recovery Score Works

Kreev computes your Recovery Score using Z-score normalization against your personal rolling baseline. Each biometric metric (HRV, Resting Heart Rate, Sleep, Steps, Respiratory Rate) is compared to your own historical average from the preceding 7–60 days. The resulting Z-scores are weighted and mapped to a 0–100 scale. Your score therefore reflects deviation from your own patterns, not comparison to a population group. Your Strain score reflects cardiovascular training load estimated from your heart-rate data, and elevated strain informs the next day's recovery expectation. If you submit optional subjective check-ins, they are used to show how your felt state compares with your biometric signals; they are not an input to your Recovery Score.

22.2 Demographic Data

The Recovery Score and Strain score do not use your ethnicity or location, and the Recovery Score does not use your age or sex.

Your age and biological sex — read from Apple Health, or entered by you — are used in three places:

  • the VO2 Max ACSM ranking (Section 5.6), which positions your reading against published population norms for your age group and sex;
  • the aerobic-capacity component of the Healthspan Index (Section 22.5), derived from that same ranking; and
  • the reference maximum heart rate used in VO2 Max estimation and training-load calculation, where your own measured peak is unavailable (Section 22.6).

If neither Apple Health nor you provide them, the ranking is unavailable, the Healthspan Index is computed from its remaining components, and training load falls back to a default reference. We do not use ethnicity or location anywhere in the App.

22.3 Automated Decision Rights

Because all processing happens on your device and its outputs are shown only to you, you control it directly:

  • Explanation of how a score was computed: this section and Section 13 of the Privacy Policy describe the method; for anything further, contact privacy@kreev.app.
  • Opt out of automated scoring at any time by revoking Apple Health permissions in iOS Settings, or by deleting the App. This disables the Recovery Score, Strain score, and narratives, which cannot be produced without it.
  • Access all outputs — they are on your device, visible in the App, and included in Settings → Export My Data.

22.4 Limitations

Automated scores are personal informatics based on sensor data and statistical methods. They are not clinical assessments. Sensor accuracy depends on hardware (Apple Watch or compatible wearable) and on user behaviour (consistent wear, proper fit). Scores during the first 7 days of use may be less stable due to limited baseline data, and some features require a longer history before they appear at all.

22.5 Healthspan Index

The Healthspan Index is a composite score from 0 to 100, available on the Sentinel tier. It combines five components, each scored from 0 to 20:

Each component is a whole number, and when all five are available your score is exactly their sum — you can add up the figures the App shows and arrive at your own score. Each component requires at least 5 days of data before it contributes. If fewer than five are ready, the available components are scaled to the 0–100 range and the App shows you how many are contributing; a scaled score will not equal the sum of the components shown.

Unlike the Recovery Score, the Healthspan Index is not purely self-referenced. The aerobic-capacity component compares you against population norms for your age and sex, and the sleep-regularity component is scored against fixed reference bands rather than against your own history. The remaining three components are computed from your own baseline.

The Healthspan Index is a summary of fitness measures. It is not a medical assessment, it does not diagnose anything, and it does not predict health outcomes, disease risk, or life expectancy.

22.6 VO2 Max Estimation and Its Basis

Kreev estimates your VO2 Max on your device from the ratio of your maximum heart rate to your resting heart rate (the Heart Rate Ratio method, Uth et al. 2004), rather than displaying the reading produced by your watch.

That estimate needs a maximum heart rate, which can come from one of two places:

  • Personalized — the highest plausible heart rate observed in your own recorded workouts; or
  • Formula-based — an age- and sex-based reference value, used when no workout you have recorded reached a high enough intensity to serve as a reliable ceiling.

The App states which basis your current estimate uses, everywhere the value appears. A formula-based estimate is a population approximation and is less informative about you specifically than one built on your own measured peak. Kreev does not tell you what heart rate to reach, and nothing in the App should be read as an instruction to train at any particular intensity.

23. Export Compliance

You represent that you are not located in a country subject to a government embargo and that you are not on any government restricted-parties list.

24. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification before they take effect, and where required by applicable law we will seek your renewed acceptance. If you do not agree to updated Terms, you must stop using the App, and you may erase your data and delete the App as described in Section 8 of our Privacy Policy.
